In Silwan, a Palestinian neighbourhood near Jerusalem's Old City, Israeli settlers are increasingly encroaching on Palestinians' land.

Tension there are high after the Jerusalem municipality approved a controversial plan to demolish 22 Palestinian homes to make way for a park and shopping complex.

The European Union has warned Israel over its plans to demolish dozens of Palestinian homes in occupied East Jerusalem.

"Settlements and the demolition of homes are illegal under international law, constitute an obstacle to peace, and threaten to make a two-state solution impossible," a statement issued by Catherine Ashton, the EU's foreign policy chief, said.

Al Jazeera's Sherine Tadros visited the families whose homes are threatened by Israel's demolition plans.

A report by the charity Save the Children has said that living conditions in parts of the West Bank are now so dire that people living there are worse off than in blockaded Gaza.

The charity claims that an estimated 40,000 Palestinians living under Israeli control are prevented from performing even the most basic repairs to homes, schools and hospitals.

The Holy Land Foundation Case
Defending My Father ... and the Constitution

The case perhaps most notably authorized by the Material Support Law, which was upheld by the Supreme Court on Monday, was that of the Holy Land Foundation, once the largest Muslim charity in the United States. My father, Ghassan Elashi, co-founded this charity, and after two lengthy, expensive trials, he’s now serving a 65-year prison sentence.

The panel was split 6-3, the valiant minority being Chief Justices Stephen G. Breyer, Ruth B. Ginsburg and Sonia Sotomayor. Writing the majority opinion, Chief Justice John G. Roberts concluded that the Material Support Law is not too vague and does not violate the First Amendment, opposing the extensive arguments of constitutional law expert David Cole who, along with the Center for Constitutional Rights, challenged the law in the Supreme Court. Chief Justice Breyer wrote the dissenting opinion, stating that the law could criminalize speech and association “only when the defendant knows or intends that those activities will assist the organization's unlawful terrorist actions.”

The Patriot Act, which expanded a provision in the Material Support Law to include those who provide “assistance,” essentially made it illegal to send charity to the U.S. Treasury Department lists of desig nated terrorists. The Holy Land Foundation, or HLF, was never found guilty of giving charity to a desig nated terrorist organization. Rather, they were convicted of conspiring to give material support in the form of humanitarian aid to Palestinian charities called “zakat committees” that prosecutors alleged were fronts for Hamas, which was designated in 1995.

A Texas jury deadlocked in the first trial in 2007, defending the defense’s main argument: that USAID, Red Cross, the UN, CARE and many international NGOs sent money to the same zakat committees listed on the HLF indictment. But in the 2008 retrial, after essentially the same arguments, the jury returned all guilty verdicts. My father is currently being held in a Communications Management Unit in Marion, Illinois, a prison that's been called "Little Guantanamo" since two-thirds of the inmate population is of Middle Eastern descent.

The Supreme Court decision is not the most optimistic news regarding the HLF case, which is now under appeal. Nevertheless, defense attorneys assert they still have strong grounds for appeal, including the prosecution’s evidentiary errors and anonymous expert from Israel who claimed he could smell Hamas and testified under a fictitious name, thereby preventing defense attorneys from effectively cross-examining him.

According to the ACLU, the Material Support Law is “in desperate need of re-evaluation and reform.” The Supreme Court didn’t see that need, but hopefully, Congress will see that the law is shredding our Constitution in the name of national security and undermining bona fide humanitarian efforts, thus, causing an economic chokehold on Occupied Palestine.

In the small hours of this night, around 3 am, Israeli Occupation Forces raided the village of Bil'in to effect the political arrest of villager; Yasir Maher Yasseen who, happily evaded their clutches yet again. The IOF have a long history of harassing and jailing this young activist and excepting the kidnapping of 13 year old Fadi Al-Khatib on the 4th of this month and the terrorising of a false confession out of him, this raid comes after a relatively long hiatus (22-05-2010 was the last military incursion into the village) and may be a harbinger for a spate of further terrorising raids to come.? Ashrah Abu Rahmah, brother of Bassem who the IOF murdered on 17-04-2009 at a peaceful protest at the nearby Apartheid-Annexation Wall, distinguished himself yet again with his relentless and brave efforts to breach the IOF cordon around the home of Yasir. Bil'in salutes him.

For the past five weeks, Bil'in was an Israeli Occupation Forces free zone, last night, however, the ugly face of the Occupation manifested itself again when the IOF violated the peace of the village and reentered in strength at 3 am in a vain attempt to arrest Yasir Maher Yaseen. Mission unaccomplished, they motored off disgruntled and cursing, no doubt hell bent on returning to finish their dirty business, perhaps tonight.? Whilst there, brave Ashraf Abu Rahmah repeatedly challenged them by attempting to break through the cordon of aggressive soldiers around the home of Yasir and received rough handling as a result.

Israel has recently announced plans to expel four Jerusalemite politicians because of their participation in the Palestinian Legislative Council and the Hamas government.

Three deputies and the former Minister of Jerusalem Affairs have had their Jerusalem identification cards confiscated and face expulsion from the city for a period of one month, to begin on July 2nd.

Israeli human-rights groups and Mahmoud Abbas, the president of the Palestinian Authority, have condemned a decision by Israel to expel four Palestinian politicians from East Jerusalem by the end of this week.

The Israeli government revoked their residency rights in Jerusalem a few weeks ago, after claiming they were “in breach of trust” for belonging to a “foreign parliament”, a reference to the Palestinian Legislative Council.

All four men belong to Hamas and were arrested a few months after taking part in the Palestinian national elections in January 2006. They remained in jail until recently as “bargaining chips” for the release of an Israeli soldier, Gilad Shalit, who is being held captive by Hamas.

Observers say Israel’s move reflects its anger at Hamas’s growing hold on the political sympathies of Jerusalem’s 260,000 Palestinians and is designed to further entrench a physical separation Israel has been imposing on East Jerusalem and the adjacent West Bank.

Israel has not said where the three MPs and a former cabinet minister will be expelled to. The loss of residency effectively leaves the politicians stateless, in breach of international law, according to human-rights lawyers.

Hassan Jabareen, the director of the Adalah legal centre for the Arab minority in Israel, said a “very dangerous precedent” was being set. “It is the first time Palestinians in East Jerusalem have had their residency revoked for being ‘disloyal’ and this could be used to expel many other residents whose politics Israel does not like.

“This is a draconian measure characteristic of dark and totalitarian regimes,” he said.

The January 2006 vote for the Palestinian Legislative Council, in which Hamas won a majority of seats against its Fatah rivals, was the first time the Islamic party had participated in a national election.

Jerusalem politicians were allowed to stand only after the international community insisted that Israel honour the terms of the Oslo accords.

Unlike the occupied Palestinian territories of the West Bank and Gaza, East Jerusalem was annexed to Israel following the 1967 war and its Palestinian inhabitants were given the status of “permanent residents”. Israel has violated international law by building large settlements throughout East Jerusalem that are now home to 200,000 Jews.

After the 2006 vote, the government of Ehud Olmert responded to Hamas’s success in East Jerusalem by initiating procedures to revoke the residency of three MPs – Mohammed Abu Tir, Ahmed Attoun and Mohammed Totah – and Khaled Abu Arafeh, who Hamas appointed as the PA’s minister for Jerusalem affairs.

Before the revocations could take effect, however, Israel arrested the men, as well as dozens of other Hamas legislators, in retaliation for Sgt Shalit’s capture four years ago.

Since their release, all four politicians have had their Israeli identity cards confiscated and been told they must leave the city within a month.

Mr Abu Tir, 60, was supposed to leave on June 19, but has so far evaded expulsion. “I will not willingly leave the place my family has lived for 500 years,” he said last week.

The deadline for the other three expires on Saturday.

Unusually, the plight of the Hamas politicians has won the support of Mr Abbas, who also heads Fatah and has been seeking to overturn Hamas’s rule in Gaza.

Calling the expulsions one of “the biggest obstacles yet on the path to peace”, Mr Abbas has vowed to put pressure on the US to reverse Israel’s decision.

During a meeting with three of the men last week, he said: “We cannot stand idly by while people are expelled from their homeland, which we consider a crime.” Mr Abbas is reported to fear that Israel is hoping to establish a new precedent for expelling thousands of Palestinians from the city.

Hatem Abdel Kader, Fatah’s minister for Jerusalem affairs, was warned this month by the Shin Bet, Israel’s secret police, that he would have his residency revoked if he continued his political activities in the city.

Yigal Palmor, a spokesman for the Israeli foreign ministry, said Israel was issuing “a very clear warning to Hamas and all those who promote terror” that they would face a “backlash”.

Lawyers for the four Hamas politicians petitioned the Israeli Supreme Court this month for an injunction on the expulsions until a hearing can be held on the men’s residency rights. Last week, however, the court declined to stop what it called “deportations”, saying it would issue a ruling at a later date.

Mr Jabareen, whose Adalah organisation is advising the politicians, said he was “astonished” by the court’s position, and that in all previous expulsion cases an injunction had been issued before the expulsion took place.

He added: “Under international law, an occupying power cannot demand loyalty from the the people it occupies. Palestinians in East Jerusalem are ‘protected persons’ in law and cannot be expelled.”

Israel has based its decision on the Entry into Israel Law of 1952, which governs the naturalisation process for non-Jews. It allows the interior minister to revoke citizenship and residency in some cases.

“The purpose of this law is to oversee the entry into Israel of foreigners,” said Mr Jabareen. “The Palestinians of East Jerusalem did not enter Israel; Israel entered East Jerusalem by occupying it in 1967.”

The revocations of the politicians’ residency comes in the wake of a rapid rise in the number of Palestinians who have been stripped of Jerusalem residency on other grounds, usually because Israel claims the city is no longer the “centre of their life” and typically because a resident has studied or worked abroad.

In 2008, more than 4,500 Palestinians lost their Jerusalem residency, interior ministry figures show. The number has been steadily rising since 1995, when 91 Palestinians were stripped of their rights. According to Israel, a total of 13,000 Palestinians have had their residency revoked since 1967.

The loss of residency is seen by the Palestinians as part of a wider Israeli strategy to weaken their hold on East Jerusalem and its holy sites.

Israel has built sections of its separation wall through Palestinian neighbourhoods of Jerusalem, cutting off some 60,000 residents from their city.

It has also shut down all Palestinian political institutions in Jerusalem associated with the Palestinian national movements, and banned events – including a literature festival last year – that it claims are financed with PA money.

Last week police forced the closure of Hamas’ political office near the Old City. Yuval Diskin, the head of the Shin Bet, had earlier accused Hamas of trying to buy property in Jerusalem.

In early 2006, shortly before they were arrested, Mr Abu Tir and Mr Abu Arafeh were revealed to have established a diplomatic channel with several prominent Israeli rabbis to negotiate Sgt Shalit’s release and the terms of a possible peace deal. The talks were effectively foiled by their arrests.

In a related move, Israeli officials have also been threatening to revoke the citizenship of Palestinian leaders inside Israel, including Haneen Zoubi, the Israeli MP who was onboard last month’s aid flotilla to Gaza that Israeli commandos attacked, killing nine passengers.

17-Year-Old Seriously Injured During Clashes Yesterday

Yesterday, during the clashes in Silwan, Muhannad Mahmoud al-Qawasmi, 17, was seriously injured. Muhannad was shot in his right eye from a rubber bullet by a soldier that aimed his weapon directly at him from a short distance. Muhannad was on his way to assist a medical crew that evacuated residents who were injured by inhaling tear gas.

Muhannad was hospitalized in St. John hospital in Jerusalem. The doctors could not save his eye, and had to remove it during the surgery.

Around midnight, clashes broke out in Baten el-Hawa neighborhood in Silwan between Silwan residents and private security guards of the “City of David” settlement, after provocation by the security guards. The incident took place next to “Beit Yonathan” settlement house. Large forces of army and border police have arrived and are using live bullets. 12 people have been reported to be injured by tear gas which entered the residents’ homes. Two pregnant women were treated by medical staff who arrived in ambulances.

Violent clashes continue today, for the 7th day, in the village of Silwan. The clashes take place in Baten el-Hawa and al-Bustan neighborhoods. 50 people have been reported to be injured, most of them by tear gas. Mouhaned el Kawasmi, a 16 year old boy, has been shot in the eye by a rubber bullet. There are also reports about an attack on the house of Abdalla Abu Nab by settlers. The house of more than 40 people, was once a synagogue of the old Yemen Jewish community of Silwan, and the settlers threatened they would try to take the residents out of the house by force.

[Commentary - P.V.: Let's not forget that over 500 Palestinian villages were destroyed in 1948, each one of them had a Muslim Mosque and/or a Christian Church destroyed or taken over by Israel, some of these religious sites have been turned into strip joints, bars, night clubs or even animal barns in desecration of these other religions. Such sites must be returned to Muslims and/or Christians. The refugees who were dispossessed and kicked out from their land must also be returned, repatriated and compensated.
It seems, however, that the zionist settlers can only conveniently remember Jewish sites which, in any case, pertained to the Palestinian Nation and not the colonizing entity that ethnically cleansed the absolute majority of the land of its native inhabitants and is trying to carry out the same crime of ethnic cleansing once more.]

A Pregnant Palestinian Woman Injured During Clashes in Silwan

Violent confrontations erupted again between IDF forces and Palestinian youth in Silwan. A pregnant woman was injured, when a jeep of Israeli army hit a Palestinian car. The nature and severity of the woman’s injury is not yet known. And there were no other reports of injuries.

On Friday 25-6-2010 hundreds of Palestinian Israeli and International activists, walked in Silwan to protest against the decision to demolish 22 houses, and against the Israeli policy of violence and theft in east Jerusalem. The demo was very strong and powerful. Speeches have been made, slogans shouted and samba drummed. One settler threw a few small stones at us, and no one was injured.
This was the largest demo in silwan in the last few years. And it came instead of the weekly SJ demo

Today, yet again, protestors in Nabi Salah were subjected to merciless Israeli violence with one youth injured and ambulanced away for treatment. This time, however, the perpetrators were repeatedly challenged by a brave, brave woman: Huwaida Arraf, who blocked with her body two Israeli Occupation Forces soldiers from firing killer, high velocity tear gas projectiles at some stone throwing youth. With telling truth she informed them that: "The demonstration was over and their continued presence was designed to provoke and intimidate and to go home". Her pleas were in vain as the IOF made continuous terrorising forays on foot and jeep into the village until late into the evening. Prior to the protest, at the cermony in the village square honouring the many Palestinians jailed for inordinate periods of time by Israel for resisting the Occupation, she urged people of live conscience worldwide to boycott Israeli blood diamonds as the cut diamonds are the foundation of the Israeli economy and amount to some $20 billion in exports annually. Huwaida Arraf is a Palestinian-American human rights activist who co-founded the International Solidarity Movement and is currently chair of the Free Gaza Movement, she was on board Challenger 1, one of the six siege-breaking ships ferrying desperately needed humanitarian supplies to Gaza when the flotilla was murderously attacked in international waters by Israeli commandos on 31st May 2010 - nine other human rights activists aboard the Turkish ship, Mavi Marmara were murdered in cold blood, . Huwaida witnessed the terrorist attack on the Marmara before her own ship was boarded and its passengers and crew subjected to Israeli savagery. In August 2008, Huwaida was on the Free Gaza boats that sailed from Cyprus to Gaza, the first boats to challenge Israel's closure of the Strip and dock in Gaza Port in over 40 years. She has since lead 4 other successful solidarity missions to Gaza with the Free Gaza Movement. In February 2009 Huwaida was part of a National Lawyers Guild delegation that traveled to Gaza to document possible Israeli violations of international law and war crimes that may have been committed during Operation Cast Lead. Dozens suffer from tear gas inhalation and ten injured in Bil'ins weekly demonstration Today's protesters in Bil'in brought out the message about boycott of Israeli blood diamonds. Every year, consumers the world over unwittingly spend billions of dollar on diamonds crafted in Israel, and Palestinians call for a boycot...t. The demonstration went on as usual, Palestinians, Israelis and internationals marched together up to the gate of the wall, facing large amounts of tear gas before the soldiers went in through the gate and chased the protesters some hundred meters towards the village. Israel, that stands accused of war crimes, crimes against humanity, ethnic cleansing, genocide, the crime of apartheid, extrajudicial executions within and outside the territory it controls and persistent serious breaches of the Geneva Conventions -- is the world's leading exporter of diamonds. Today the villagers carried t-shirts and posters asking to boycott Israel's diamond industry. About 100 demonstrators went up to the gate, carrying out the message, in a non violent manner. Another message was solidarity with the Palestinians in Jerusalem, facing eviction from their homes and constant violence from Israeli settlers taking over their houses. The soldiers responded with shooting tear gas into the crowd after ten minutes. As people were running towards the village, the soldiers were running after, still shooting tear gas, and dozens suffered from inhalation. Three soldiers were reported to hide in the field close to the village, shooting tear gas making it difficult to reach back towards the village. About ten protesters suffered heavily from the gas, struggling to breathe. Tear gas canisters caused a fire in the field, on both side of the road as the hot canisters hit the dry ground. In the middle of a cloud of tear gas Palestinians were working hard to stop the fire, which was spreading quickly among the olive trees. In the end they managed to put an end to the fire, which caused a lot of smoke in addition to the tear gas. The demonstration lasted for about 45 minutes, when people went back to the village.
