المؤتمر الصحفي الخاص بقرار الغاء القضاء العسكري:

اعلن شعوان جبارين مدير مؤسسة الحق لحقوق الانسان انه تم ابلاغهم بصفتهم كعضو في مجلس منظمات حقوق الانسان الفلسطينية بقرار من جهاز المخابرات العامة، وبعد التنسيق مع الجهات السياسية العليا ينص على انه ابتداء من يوم غد لن يتم اعتقال اي مواطن فلسطيني في الضفة الغربية الا بمذكرة توقيف من قبل النيابة العامة المدنية الفلسطينية.

واكد جبارين انه ابتداء من يوم غد لن يكون هناك اي اعتقال او احتجاز عن طريق القضاء العسكري، او النيابة العسكرية، وان جميع الملفات والقضايا ستحال الى القضاء المدني، وفق ما ورد من جهاز المخابرات العامة، وبعد التشاور مع الجهات السياسية العليا.

واوضح جبارين ان القرار جاء نتيجة الجهود المبذولة من مجلس منظمات حقوق الانسان، والمؤسسات المختلفة التي عملت بكل طاقتها لانجاز ذلك القرار، مثمنا هذه الخطوة، وتاركا للايام القادمة الحكم على مدى الالتزام بها.

واعرب جبارين خلال مؤتمره الصحفي عن امله ان يساهم هذا القرار في تحقيق حرية الانسان وكرامته، وان يساهم في انجاز المصالحة، وانهاء ملف الاعتقال التعسفي في الضفة الغربية وقطاع غزة، وان يساهم في الافراج عن المعتقلين الموقوفين على ذمة القضاء العسكري.

وشدد جبارين على ضرورة احترام سيادة القانون الفلسطيني، معربا عن ثقته بالقضاء الفلسطيني، وان يكون بمستوى الرهان عليه.

وحول الاعتقالات السابقة، اكد جبارين ان جميع الملفات ستحال الى القضاء المدني للنظر والبت فيها، مشيرا الى انه تلقى وعوداً بالافراج عن بعض المعتقلين خلال الايام القريبة القادمة.
Palestinian General Intelligence: civilians will be no longer tried in military courts

As an organisation dedicated to the protection and promotion of human rights in the Occupied Palestinian Territory (OPT), Al-Haq is pleased to announce that its three-year-long efforts to condemn the illegal practices used by the Palestinian Authority (PA) in the West Bank, including the application of military legislation to civilians, has successfully resulted in the abolition of this practice.

Since 2007, Al-Haq has been engaged in a campaign against the PA's illegal practices, such as arbitrary arrests, torture and ill-treatment of detainees and the application of military jurisdiction to civilians. The campaign entailed numerous meetings with policy and decision makers, including the Prime Minister, the Minister of Interior and security agencies, to condemn the illegality of such practices and their effects on Palestinian society as a whole. Al-Haq has produced a report in Arabic analysing the illegality of extending military jurisdiction to civilians from both a substantial and procedural point of view. Such application of military jurisdiction is illegal under Palestinian Basic Law and was enacted without being published in the Official Gazette, an essential requirement for the formal entry into force of new Palestinian legislation.

On 15 January 2011, the Palestinian General Intelligence in the West Bank called for another meeting with the General Director of Al-Haq, as one of the representatives of the Palestinian Council of Human Rights Organisations. The Head of the Legal Division, Mr. Fawaz, stated that, after consultations with both the political leadership and the security agencies in the West Bank, a formal decision was made to ban military courts from prosecuting civilians. Starting from Sunday 16 January 2011, all security agencies operating in the West Bank have been ordered to strictly abide by civil procedural law when civilians are involved in alleged violations. Military arrest warrants can no longer be issued against civilians, and civilians illegally detained as a result of military arrest warrants will be released. The Chief of the Military Judiciary, Mr. Mobaied, confirmed that from now on civilians will not be tried in military courts and those awaiting trial will have their case transferred to civilian courts
